What is an Uncontested Divorce?

An Uncontested Divorce is a divorce where both spouses agree that the marriage is to end and both are able to come to a mutually satisfying agreement regarding the final divorce settlement.

  • Both Mutually Agree On The Split of the Kids, Assets, etc.

First, both of you must agree to the divorce. While this may sound simple, frequently one party in the marriage does not wish to get divorced. Again, both spouses agree that the marriage is to end.


Second, both of you must agree on the splitting of the assets, children, and any alimony to be paid to one spouse or the other. This is where the trouble usually sets in...  If you are unable to agree, this is called a Contested Divorce. 


It is usually best if you are able to agree by sitting down together and having a conversation about these issues.
